Colorado Misdemeanor Process

In Colorado, Misdemeanor charges have a different path through the courts than Felony charges.  And, they have different ranges of punishment.  These two charts will help explain the process.

The Basic Misdemeanor Process

  1. The Alleged Crime:  What Happened
  2. Case is started:  arrest; ticket is issued; or indictment
  3. Arraignment:  This is where you plead not guilty
  4. If you want a jury trial:  within 20 days request this is writing (if municipal case, pay $25.00 jury fee as well)
  5. Pretrial Conference with Prosecutor:  Plea deal reached or set case for trial.
  6. Motions Hearings:  Motion to Suppress, etc.
  7. Trial:  Either to the Court of a Jury
  8. Sentencing:
 

* Charges labeled as extraordinary risk carry an increased maximum sentence
(18 months is increased to 24 months in the county jail)

Examples of Extraordinary Risk Crimes include Third Degree Assault,
Child Abuse, Violation of Restraining Order (only for second or later offenses),
and Unlawful Sexual Contact.
